    One postscript, if I may:

There is a documented history, writ at the time, in books and technical
articles. Opinions are nice, facts are facts. (And, yes court cases,
tho courtrooms may or may not be the best places to settle such matters.
The 1943 case was brought by RCA, for their own commercial interests.)

The internet, while opening up much of questionable accracy, has also brought
many things of once rareity within reach of all. In the Instance case:
      Google
       Books
        search on
         wireless history Fahie

Free for download, 1902 History of Wireless Telegraphy
Hint: Tesla gets some mentions. Before 100 years of mythmaking came along.

As to gap inventions, the spark gap wireless crew used 'all'. Similar
    books for download.

Similarly books (old) specifically by and about Tesla.

    Same source, search:
      Lighting Conductors Guards Lodge
For a moderately earlier, and fascinating view. Including a VERY early reference
to the 6.mumble Hz Earth resonace later cited by Tesla & Schumann & etc.

Another resource, which I've not explored in depth:
       www.archive.org
    Likely some overlap.
